This policy explains what personal information we collect when you use kelberg.com or contact us through it, why we collect it, who we share it with and how long we keep it. It also sets out the rights you have over your information and how to use them. We have written it in plain English rather than legal boilerplate; if anything is unclear, ask us using the contact details at the end.
1. Who we are
This website is run by Kel-Berg Trailer and Trucks Limited, trading as Kel-Berg Trailers & Trucks. We are registered in England and Wales, company number 02657061, and our registered office is Kel-Berg House, Middleton Stoney Road, Weston on the Green, Bicester, Oxfordshire OX25 3TH.
We are the data controller for the personal information collected through this website, and we are registered with the Information Commissioner’s Office (ICO) under registration number ZA447977.
Data protection queries are handled by Sabrina Verner, Office Manager. You can reach her at sabrina.verner@kelberg.com or on 01869 343 511.
2. The information we collect
Most of the information we hold about you is information you give us yourself, through one of the forms on this site:
- Contact form: name, email address, phone number, company name and your message.
- Get a Quote form: name, email address, phone number, company name, your message and the equipment you are interested in.
- MOT booking form: name, email address, phone number, company name, your message and the vehicle registration number.
- Newsletter signup: name, email address, phone number, company name and your position.
When you submit any form, our website software also automatically records your IP address and browser details alongside the entry. This happens with every submission and helps us spot spam and misuse.
If you contact us directly by phone or email, or go on to buy equipment or services from us, we will hold the details of that correspondence and transaction too, such as order, delivery and payment information.
3. How we use your information
UK data protection law requires us to have a lawful basis for each use of your information. These are the ways we use it and the basis for each:
- Answering your enquiries and preparing quotes. We use your contact details and message to respond to you. This is a legitimate interest: you have asked us a question and expect an answer, and where a quote may lead to a sale it is a step taken at your request before entering a contract.
- Supplying equipment and services, including MOT bookings. We use your details to fulfil the order or booking. This is necessary for the contract between us.
- Sending the newsletter and stock updates. We only do this if you have signed up, and rely on your consent. See the next section for what you will receive.
- Keeping accounts and business records. We keep records of transactions to meet our legal obligations, including tax law.
- Keeping the website and forms secure. We use the automatically recorded IP address and browser details to detect spam and abuse. This is a legitimate interest in protecting our systems.
- Understanding how the website is used. We collect statistics about visits (pages viewed, how visitors found us, device type, region) and look at them only as totals, to improve the website. This is a legitimate interest in running a website that works for its visitors. It is on by default and you can switch it off at any time in the cookie settings; see our Cookie Policy.
We do not use your information for automated decision-making or profiling that has legal or similarly significant effects on you.
4. Marketing emails
If you sign up to our newsletter you will receive:
- our stock list, roughly once a month;
- our newsletter, as and when we have news worth sharing;
- HGV MOT date availability, usually once a month when dates are released.
These emails are sent through our customer relationship system or our email newsletter platform. We only send marketing email to people who have signed up for it, and every email includes an unsubscribe link. You can also unsubscribe at any time by contacting us directly; we will keep a minimal record of your address on our suppression list so we do not email you again by mistake.
We never sell your details to anyone, and we do not share them with other businesses for their own marketing.
6. International transfers
Our tipper bodywork is built at the Kel-Berg factory in Denmark. Where your order involves the factory, your name and the details of your order are shared with it. Denmark is in the European Union, and transfers to the EU are covered by the UK Government’s adequacy regulations, so your information has equivalent legal protection there.
Some of these service providers may process information outside the UK, for example in the United States. Where that happens it is protected by recognised safeguards, such as the UK’s adequacy decisions (including the UK-US Data Bridge) or international data transfer agreements approved by the ICO.
7. Cookies and tracking
The website uses cookies and similar technologies for security, website statistics, session recordings and advertising. Security cookies are always on. Website statistics are on by default, as the law allows for statistics used only to improve a website, and you can switch them off at any time. Session recordings and advertising cookies only run if you agree to them through the cookie banner, and you can change your choice at any time. The full list of what we use, what each one does and how to control them is in our Cookie Policy.
8. Your rights
You have the following rights over the personal information we hold about you:
- Access: ask for a copy of the information we hold about you.
- Rectification: ask us to correct anything that is wrong or incomplete.
- Erasure: ask us to delete your information where we no longer need it.
- Restriction: ask us to stop using your information while a question about it is resolved.
- Objection: object to uses based on our legitimate interests, and to any direct marketing at any time.
- Portability: receive the information you gave us in a reusable electronic format.
- Withdrawing consent: where we rely on your consent, for example the newsletter or optional cookies, you can withdraw it at any time.
To use any of these rights, contact us using the details below. There is normally no fee, and we will respond within one month.
9. Contact and complaints
Questions, requests and complaints about how we handle personal information should go to Sabrina Verner, Office Manager, at sabrina.verner@kelberg.com or on 01869 343 511, or by post to Kel-Berg House, Middleton Stoney Road, Weston on the Green, Bicester, Oxfordshire OX25 3TH.
If you are not happy with our response, you have the right to complain to the Information Commissioner’s Office (ICO). You can do this at ico.org.uk or by calling 0303 123 1113.
